Michael McCarty died on November 17, 1843 at Alabama at 89 years of age.1 He NOTE: Much of this biography comes from the McCarty Family History[241]. Author Unknown

'Michael McCarty born 1732, died 1854--age 122 years.' So reads an entry in the Bible of James McCarty, great-grandson of this Michael.James copied the entry from the bible of his father, Tillman McCarty, son of Philip McCarty, son of Michael.
This Michael McCarty was born in Edgefield, South Carolina.
In the 1810 census of Edgefield, South Carolina, the home of these McCartys, there are at least three Michael McCartys. In the Revolutionary history of this section of South Carolina, four Michaels are found. In 1820 two Michaels still remain in Edgefield, but in 1830 no Michael appears in the census at all.
Mrs. Eula McCarty Lansford of Crockett, Texas, says, 'My father told me that his great-grandfather Michael lived in Jefferson County,Alabama, and that he once owned the land on which Birmingham now stands and leagues and leagues besides.' Her father, Michael, was brother of James and son of Tillman.
A Michael McCarty of Jefferson County, Alabama, lived in Short Creek and owned land there, but diligent search has not shown that he was a large land owner in Jefferson County.
On July 18, 1834, Michael McCarty sold land to Amos Lea for $300. It is listed in Book 5, p. 153 as N.E. 1/4, Sec. 20, Township 17, Range5, west. John B. Ayers is witness. The deed was signed 'Michael McCarty' and 'Nancy McCarty.'

In Book 6, p. 248, March 26, 1838, Michael borrows $56 from Robert Waldrop to be paid on March 1, 1839. Michael, as security, uses a 10 year old Negro boy, Loose. This agreement is witnessed by Nehemiah Taylor, Amos Lea, and A. C. Waldrop.
Michael had five sons and at least three daughters, if he is the father of Philip McCarty of Dale County, Alabama, and of Penelope McCarty Musgrove of Blount County, Alabama. Mike McCarty, Jr., was surely his son, and Henry, James, and Benager were three other sons living near him in Jefferson County.
If Michael was the father of Penelope Musgrove, he was also the father of two other daughters (given names unknown) one of whom married a Philip Slaughter and the other a Talliferro, probably Philip.
Michael and Nancy gave their consent for the marriage of Henry McCarty and Elvira Gilley December 9, 1838.
Descendants and friends of Benager and James McCarty of Jefferson County, Alabama, testify that James and Benager were Michael's sons and half brothers of Henry.
In a letter from Mr. John Trice of Quinton, Alabama, 1955, concerning Michael McCarty of Jefferson County he says: 'I am a great-grandson of Michael McCarty. My mother was Mary Ann McCarty, daughter of Benager McCarty, son of Michael, the Revolutionary soldier. I heard my Uncle Philip Wilson McCarty speak of him . . . . I do not know whether Michael ever lived in what is now Birmingham. Elyton was the county seat in Michael 's time     . . . .I have heard from my mother and others that the McCartys came to Dale County from Edgefield, South Carolina. My mother had an Uncle Henry who was a half brother to her father Benager.'
In a letter from Mr. Thomas Salter Quinton, Alabama, on January 18,1956, he had this to say about the Jefferson County McCartys: 'My fore parents came to Alabama with the McCartys in the period 1810-1820. My grandfather lived with the McCartys until he grew up and married. During that time James McCarty moved to Dale County, made a crop, sold it in the field, and moved back to this location. My grandfather, Silas Nathaniel Salter, drove a team of oxen to Dale County, spent the period of time they stayed there and then drove back here......I own the land that James McCarty entered in 1832 or 1833.
'Mahala McCarty, daughter of James, married Justice Berry, and they had one son, James. He told me that old Michael rode horseback from Short Creek to Brake Bend, about ten miles, in 1850, took sick and died at their house, age105. I would guess that he is buried in the Brake Bend, as there is an old cemetery there but there is no one living now that would know. Michael had a son Henry. His wife, Elizabeth Elvira, lived with my family more than a year when I was a boy. She said her uncle toted her on his back from South Carolina to Alabama. Aunt Elvira, as we called her, died in the Walker County Alms House when she was near 100 years old. Her husband was a teacher. They had only one child, Owen Alcy. (Alsa).'
Mr. Trice also stated that James Justice, son of Mahala, said Michael died at the home of his grandparents, Rebecca and James McCarty.
Judge Philip McCarty, judge of an inferior court in Macon County,Georgia, from 1840 to 1842, moved to Dale County in 1842 where he remained until his death in 1879. His father and at least one brother,'a red-haired old man who could put his hands on his horse's back and vault into the saddle' lived in Alabama, according to Mrs. Pet Maynard, one of Philip's granddaughters. He visited Philip many times in Dale County, riding horse back from his home to Dale.
Horse back riders figure prominently in the traditional history of the McCarty family. Michael, father of Philip, is said to have ridden horse back from South Carolina to Alabama. Philip rode from Georgia to Alabama on horse back; and Michael, age 106 rode to his death in Short Creek.
Though the connection is not too plain, three things indicate that this Michael was the father of Philip McCarty. First, Michael lived inJefferson County, and so did Philip's father Michael. Second, Jamesa nd Benegar were Michael's sons, and there are strong indications that these two sons were Philip's brothers. James moved to Dale County, and Philip was already living there. Then the family names of these three McCartys and of Henry, too, are similar. Philip had a son Alsa, and sodid Henry. Philip's second wife's name was Mahala, and James had a daughter Mahala. Alsa, Philip's son, had a daughter Catherine, and sodid James. Philip had a sister Penelope and both James and Benager had daughters named Penelope. Philip had a daughter Mary Ann, a son James, Michael, and son Wilson, a son Philip and so did Benager.

McCarty
Philip Michael McCarty NOTE: Most of the details of this biography come from the unpublished McCarty Family History [241]. Author unknown.
Phillip McCarty, son of Michael, was born in Edgefield County, South Carolina, July 21, 1791.
Phillip McCarty married, first, about 1808 or 1809, probably in South Carolina. He had six children by this marriage, but the name of only one of these children has been found for this history. Neither is the name of his first wife known. Known children: Bethany or Bethane.
Phillip married, second, Mahala Boddie, about 1818, probably in South Carolina. She died in Edgefield, South Carolina in 1832. Children: William Allen, Alsa B., Wilson S., Tillman, Mary Ann, Martha,Elizabeth.
Phillip first appears by name in the Edgefield Co SC census in 1820,pg 103: Philip McCarty 100010 00100. At that time he was living with his second wife, Mahala Boddie, and their one-year son William Allen.Where he was before that is not known, but he had married prior tothat time, and he and his first wife had six children, only one of whom appears in this history. He and Mahala had seven children, and he and Mary Mitchell, whom he married shortly after Mahala died, also had seven children. Phillip, therefore, was the father of twenty children, but the genealogy of only fifteen of them have been identified.
Where any of this family of McCartys were found they owned land, for they were farmers, primarily. In Book 42, p. 287 in Edgefield records is this record: Philip McCarty to Amos Satcher, for $150. 100 acres of land situated on the P. district on Gillons Branch......of McCarty'sSpring Branch, part of a tract of 430 acres granted to BenjaminArribgton on December 3, 1789 bounded by Amos Satcher, G. W. Stanmore,Hezekiah Waters, James Daniel. 2 January,1821.
Signed, Philip McCarty Witnesses: West Bodie, Samual Satcher
1830 Edgefield Co SC, p155: Philip McCarty. There are several other McCarty's in the same County
Mahala died between March 24, 1831 and July, 1832. Philip and Mary married as early as this late date, for twins, John Sion Jeter and Sophronia McCarty, were born to them on April 8, 1833. Mahala had been ill for some time before her death, and Polly was hired to take care of her and run the household during Mahala's illness. Elizabeth,Mahala and Philip's youngest child, was born in late 1831 or early1832. Cause of Mahala's death is not known.
Phillip married, third, Mary (Polly) Mitchell at Edgefield, SouthCarolina, in 1832. She was born November 18, 1803 and died October 27,1888 in Dale County, Alabama. Children: John Sion Jeter, Sophronia(twin to Jeter), Walter D., Thomas Randall, Georgiana, Phillip Tipton(Tippy), James Michael.
Philip bought land in Edgefield in 1832 as this entry shows: 'Philip McCarty 617 acres on Richland Creek in Edgefield County, 19 April,1832. Surveyed by Amos W. Satcher and by lands of William B. Knight,Dr. Grant, Francis Spraggins, Robert Stark, and Isaac Crouch. Chainbearers, Lewis Herlong and John Crouch.'
Philip and his family moved from Edgefield to Lanier, Macon County,Georgia, about 1836. New lands were being opened up in Georgia, and perhaps he saw new opportunity there.
Elected judge of an inferior court in Macon County, in 1840, he seems to have served only one term, moving to Alabama at the end of that time. From this short tenure in office, he acquired the title of 'judge' and was known there after as Judge Philip McCarty.
1840 Macon Co GA, p 18: Philip McCarty. There is also a WilliamMcCarty.
In Macon County, Georgia, tax returns show that Philip paid taxes on1200 acres of land. He might have owned more land, but no other records are available, as the court house burned in Macon in 1856.
He remained in Macon Co GA until 1842 when he moved to Dale County,Alabama, where he remained until his death.
1850 Dale Co census, p 228: Phillip 58 farmer $4500 SC, Mary 45 can'tread/write, Elizabeth 18 SC, Geter 17 m SC, Saffronia 17 SC, Walter 15SC, Thomas 13 SC, Georgia Ann 12 GA, Phillip 9 GA, James M. 7 GA,Moses Prescott 65 SC laborer
Value of Philip's land in Dale was given in the 1850 census as $10,000 and his personal property as $30,000. He had twenty-eight slaves atthis time, though family tradition says he had 'more than 100 slaves.'
1860 Dale Co AL census, p 510: Phillip McCarty 68 farmer $10,000$31,000 SC, Mary 56 SC, Philip 18 GA, James 17 GA, Martha 21 GA,George Ann 1 AL, Walter 25 GA

Mrs. Philip Jeter McCarty Maynard (Pet), daughter of John Sion JeterMcCarty, remembered many stories of the old days in Alabama and enjoyed telling them at her home in Alto, Texas, in 1957 when we visited her. (from the author of the McCarty book)
'Those who knew Philip remember him as a stern, just man, a strict disciplinarian. He was well educated and gave all of his children better than an average education of that day. Though he was considered a well-to-do farmer, he still believed that work was good for his children and kept them busy. He would not tolerate the desecration of the Sabbath and never allowed any of his family or slaves to work on Sunday.
'Philip was a small man with 'gander blue' eyes and fiery red hair and a fiery temper. When his children needed a tanning he saw that they got it. Once one of the boys, Tom, I believe, kept hanging around the house instead of going to work. His father asked him why he was not in the field. When the boy answered, 'I am waiting for my whipping,'Philip quickly replied, 'Well, come here. What did you do?''
'Though stern discipline ruled the household, there was fun and humor there too. Once when Uncle Silas, the slave who worked the cotton press at the gin, came in very tired and covered from head to toe with lint, Jeter and Wilson, seeing a great opportunity, touched a match to the lint, and for a moment Silas was covered in flames. Though the boys scooted under the bed, they did not escape the righteous wrath of Silas. He pulled them from their hiding place declaring he would whip them if it was the last thing he ever did.'
'Though Philip had several sons that drank rather heavily, he confined his drinking to a 'hot toddy' each morning. His bottle stood on the mantle in his room always.'
'The McCarty home in Dale County was a large two-story house with fireplaces in five of the rooms. After James, the youngest child, moved into the home and became manager after his father's death, he razed the old house and built a modern home. That home, however, no longer still stands.'
His will shows that he owned something more than 2000 acres when he died, much of which is a part of Fort Rucker today. He had owned a great deal more land than this 2000 acres in Dale, for when any of hischildren married, he gave that child land on which to start a new life. That is, perhaps, the reason the McCartys in Dale lived so close together. Pet said Philip lived about five miles from Daleville and near the McCarty Cemetery. Both Georgia and Sophronia Averett, his daughters, lived about three miles from Philip, while Walter, a son, lived no more than a mile away and Jeter no more than two miles away.'They all lived close,' Pet remembered.
Phillip McCarty and his third wife, Mary Mitchell, are buried in the Averett-McCarty Cemetery near and died in Dale County, Alabama, June16, 1879. Ozark, Alabama, now on the grounds of Fort Rucker. They have a marker.
Philip made his will on June 7 and died on June 15, 1879. He willed everything he owned to his wife, Mary, and his youngest son, James, was to have charge of all the properties until Mary's death. Then all was to be sold and divided 'among my lawful heirs.' James was to receive the home and 835 acres of land surrounding it and also achild's part of the proceeds of the sale of the other property. He managed the property until his mother's death in 1888. From that date until 1891 he and the family were at odds over the estate. The heirs finally sued James to recover their inheritance, and to this day McCarty descendants in Alabama may be heard to say 'James squandered the estate.' Perhaps so. The personal property brought in only $248.60 and the land only $2516. After costs were paid, the fourteen 'whole heirs' received only $151.80 each.
Philip's will points up two facts. One is that James was to care for Tom's widow and small son 'during their natural lives,' and that Tom's son's name was Philip Randall, not Thomas Randall, the name he took in later years.      Orphans' Court Records, VA p. 328-329 State of Alabama,Dale County

The question arising here is what of the six children by Philip's first marriage? Why did they not inherit their part of Philip's property? Bethany McCarty Kirklin Williams, the only one of these six children whose record is known, had died about 1865, but she hadc hildren living in both Dale and Covington counties in 1892 when distribution of the property was made. Yet today none of her descendants know why they nor their parents were not included in the settlement. Was Bethany really Philip's daughter? Her grand children say she was. Dr. Kirklin of Prichard, Alabama, says he knows she was Philip's daughter. He is the son of John Kirklin, Bethany's oldest child. John F. McCarty, son of Alsa McCarty and grandfather of Mrs. Paul Murff, who has worked on these records, wrote her about 1930 that there were six children in Philip's first family. He named none of thechildren, however.
When Mahala's father, Nathan Boddie, died in Edgefield in 1841, three McCartys are listed as owing him small sums of money: Samuel, $17;Elijah, $4.75; Nathan, $2.50. Could these be Philip's children? All the others but three on this list of debtors are kin to Nathan, eithergrandchildren or sons-in-law. These men could conceivably be Nathan'sstep grandchildren, sons of Philip.
William Bluett McCarty moved from South Carolina to Macon County,Georgia, about the same time that Philip and some of the Boddies did.He was born in 1812 and could have been one of Phillip's sons. Three of his children have typical McCarty names: William A., James M., and Elizabeth.
