     Edward Smithwick Sr. Edward was brought to Carolina at the age of ten where Indians were his only neighbors. He reached manhood when the threat of Indian depredations had hardly subsided and when the colony experienced civil war. This upheaval was followed by a tyrannical rule that imprisioned Edward on trumped-up charges. The colony had hardly settled when another governor, Seth Sothel, was appopinted, a man so unscrupulous he was first imprisioned then banished from the colony.
After coming to Carolina at the age of ten, Edward grew up on a tract of land now known as Hayes Plantation. Not far across Mattacomack (Queen Anne's) Creek was a village of the Chowanoke Indians. Upon Edward's reaching manhood, his father gave him a tract of land sometime in the early 1670s.
Edward was married three times, but no records have been found indicating the surnames of any of these wives. His first wife was Elizabeth, to whom he was married by Mar 1680, but most likely had married her in the early 1670's. It is very like that the gift of land from his father was made at the time of his marriage so that Edward would have the means to support a family.
Mar 29, 1675. The inventory of the estate of Francis Godfrey stated that Edward Smithwick owed him a debt.
1679 Albermarle Co NC. Edward Smithwick made probate of his father's deed of gift to him.
1680 Edward Smithwick, son of Hugh Smithwick of Albemarle, posts bond of 50,000 lbs of tobacco to administer his father's estate.
It appears that by May 1694, Edward was married to Africa, widow of David Jones. Africa is assumed by most researchers to be the mother of all of Edward's children.
Jun 9, 1695. Edward Smithwick appraised and witnessed the inventoryof Seth Sowell.
Sometime after the death of her second husband, Thomas Gillam, and before Oct 17, 1703, Edward and Sarah Gillam were married. This was the third marriage for both Edward and Sarah.
On Sep 13, 1712, Edward was appointed a delegate to hear an appeal from the Court of Admiralty on condemnation of a ship, Hannah & Mary Gally. Edward had been called to be on the grand jury for the Oct1713 term of court to beheld at Capt Hecklefield's on Little River but failed to appear. At this term his lawyer, Edward Moseley,instituted a suit, for Smithwick, against William Haughton but asked for a continuance which was granted. A year later Smithwick was on the jury when the court again met at Hecklefield's at which time Henry Hill of Nansemond Co VA was tried and found not guilty.

By July 1716, a courthouse had been built on Queen Anne's Creek (later named Edenton). At the term held then, Tobias Knight charged that on Feb 10, 1714/15 Edward Smithwick admitted owning Knight nine poiunds,five shillings but had refuesed to pay. When the case was called, Knight's attorney admitted the debt had been settled.
Edward was probably a very sick man at this time since he had written his will six months earlier.
His 1715 Chowan Co NC will dated Jan 21, 1715, probated Oct 21, 1716:Edward Smithwick, gentleman, son Edward - 1 shilling, John - 1s hilling, Edman, Samuel, dau Sarah mare 100 acres on Morrattok River,Hareck Smith - 100 acres, gc Edward, John, Martin, and Sarah Griffin.
He died in 1716 at his home on Kisiah (Cashie) Neck, Chowan (now Bertie) Precinct, NC and was buried near his home.

     Elizabeth Smithwick Elizabeth Smithwick was the daughter of Edward Smithwick andprobablyhis first wife, Elizabeth. Elizabeth was probably bornbetween 1680 and 1685. She married Martin Griffin ca 1700. The dateof her death is not known.She was living as last as 1723, however itis believed it was her daughter to whom reference was made in 1752. Nothing is known of the early years of Martin and ElizabethSmithwick Griffin. No record of Martin Griffin has been found priorto 1714. He appears on none of the tax lists or corn lists prior tothat date. It is apparent, though, that he was very active during theTuscarora Indian War. He presented a claim in 1714 for two pounds tenshillings. Another undated claim is for six poiunds, six shillings,six pence, and about the time of his death there is a third claim fortwenty four pounds, fiften shillings.

     Hugh Smithwick Hugh Smithwick's date of birth is unknown. Nothing is known of his parentage although there are some who feel he was a brother of Henry Smithick (born 1609) who embarked for Virginia on the Globe of London 7 Aug 1635. [161]
Hugh Smithwick is reputed to have been the first settler in the Edenton Bay, NC area, moving into NC about 1659. He settled on Mattacomack Creek (later known as Queen Annes Creek) across from present-day Edenton on what is today called Hayes Plantation.
Three years after Smithwick's arrival the population of the Albemarle had increased to the point that Governor Berkley of Virginia appointed Samuel Stephens sheriff of the 'southern plantations.'
The following year King Charles II granted the area to eight of his chief supports, the Lords Proprietors, and it officially became the Province of Carolina.
Berkley, as Governor of Virginia and as one of the Lords Proprietors still maintained control over the area until William Drummond was appointed Governor of Carolina and Virginia. Indians were continually attacking outlying settlers. Despite many petitions, Governor Berkley refused to take action. Finally a militia officer, Nathaniel Bacon,assembled a force and marched against the Indians. The military action on the north side of the Albemarle was successful enough that most of the Indians left the area which at that time had already been settled by the English.
By 1669 Hugh Smithwick had acquired nearly 17,000 acres. That year he used himself; Elizabeth, his wife; Edward, Hugh, and Ralph, his sons;Elizabeth, his daughter; and Elizabeth Bembridge as headrights to obtain nearly four hundred acres of land. In his journal describing his trip through the Albemarle area in 1672, George Fox, the Quaker leader, mentioned spending the night near the western end of the Albemarle with a Mr. Smith. Several historians feel this is a reference to Hugh Smithwick.
Sometime between 1669 and 1674 Hugh Smithwick fathered two more children; a son, John, and a daughter, Mary. Hugh died testate but in the upheaval of the times his will was apparently lost. His son, Edward Smithwick, was appointed administrator of his estate. It is presumed that Hugh Smithwick, Jr, and Ralph died between 1669 and 1675 without issue.

In 1726, at the encouragement of her brother, Edmund Smithwick, theymoved across Roanoke River and settled on Smithwick Creek in Tyrrell(later Martin) County. John Stansell died in 1750 but Sarah(Smithwick) Stansell was still living in 1776. The death of her deathis unknown.

     Sarah Godfrey Smithwick was at the encouragement of her brother Edmund, John and Sarah movedacross the Roanoke River and settled on Smithwick Creek. Type: MOVED circa 1726 at Tyrrell Co, North Carolina.3
     Circa 1726 the family of John Stansell moved from one side of the Roanoke River to the other side on Smithwick Creek which was to become part of Tyrrell Co in 1729.3
     In 1726, Sarah's brother, Edmond Smithwick Sr., persuaded John to trade some land and move across the Roanoke River and settle on the west side of Smithwick Creek.

John Jr received 320 acres from Edmond Smithwick on the south side of the Morratock River. John Jr and Sarah conveyed to Edmond the 'Deer Hall Meadows tract of land in Kisiah Neck. This tract is north of the Roanoke in the Charlton Creek area. No record can be found revealing how John Jr came by this tract of land.
