Also ordered that Henry Avera, heir at law be summoned to contest the validity of this will. Henry Avera appeared in court and said he had no objection to the probation of his fathers will. Book 1737-1749, page 219.
On the front of the cover of the will of Charles Avera is written ........by Henry Avera, to be.......being the heir at law to contest the validity of the will if he sees fit. The front cover also contains the date June 18, 1746 directly above that writing.

Many of the given names used in Elizabeth City County, VA by the Averas match the given names used by the Averas who came to the Johnston County NC area in the 1740s.

Calling unto mind The mortality of my Body and knowing that is appointed for all men once to die I do make and ordain this my last will and Testament. that is to say principally and first of all I give and recommend my Soul into the hand of almighty God that gave it and my Body I recommend to the Earth to be buried in Decent christian Burial at the discretion of my Executors. Nothing doubting but at the General Resurrection I shall Receive the same again by the mighty power of God. And touching such worldly Estate where with it has pleased God to bless me in this life I give, devise and Disspose of the same in the following manner and form.
First, I give and bequeath to Millia my dear Beloved wife one Negro wench Named Clo**e (Clovie?) and one Bay horse Called Jack. Also I give to my well Beloved son Jesse Avaritt one young horse called Pompe(?). Also I give

One Stock of Cattle at Pamlico one Stock of Cattle at (Catharey ?) and Remainderof my Estate that shall be Remaining after Legacies and all my Justdebts Paid of to be Equally Divided Between them in the followingmanner - My said son Charles Averet to have one fourth part of the said Mill Stock of Cattle and remainder of the estate and my said Daughter Mary Bryan to have one fourth part of the above mentioned articles and my Daughter Sary Abington children to have one fourth part amongst them all and to be Equally Divided amongst them shair and shair alike and my son Henry Averet children to have one fourth part amongst them all and to be Equally Divided amongst them all shair andshair alike
Lastly I nominate constitute and apoint my son Charles Averet and Noah Hinton Executors to this my Last Will and Testament hereby Revoking and disannulling all others heretofore by me made. Made in witness hereof I have here unto Set my Hand and Seal this 3 day of July 1772
